Terms of Use

These Terms of Use (“Terms”) are a legal agreement between you and Nerdbase (Jason Stark trading as Nerdbase, a sole proprietorship registered in England & Wales) governing your use of the Biltong Buddy progressive web application, iOS app, website at biltongbuddy.app, and any related services (together, the “Service”).

By creating an account, installing the app, or otherwise using the Service, you confirm that:

• You are at least 13 years old (users under 18 must have a parent or guardian’s permission); and
• You have read, understood, and agree to be bound by these Terms and our Privacy Policy.

If you are using the Service on behalf of a business or other legal entity, you confirm that you have authority to bind that entity to these Terms, and “you” and “your” will refer to that entity.

If you do not agree to these Terms, you must not use the Service and should delete your account if you have already created one.

Biltong Buddy is a personal tracking tool for hobbyist and small-scale biltong makers. It lets you log batches, record piece weights, monitor moisture loss over time, and save recipes. That is the extent of what it does.

Biltong Buddy does not guarantee that any biltong produced using the Service is safe to eat. The app is a tracker, not a food-safety advisory service. Please see the Food Safety section (Section 9) for the full disclaimer and the limits of our responsibility.

To use the core features of Biltong Buddy, you must create an account using either an email address and password or a supported third-party sign-in method (currently Google OAuth). Account authentication is powered by Supabase Auth.

When creating or maintaining your account, you agree to:

• Provide accurate and current information.
• Keep your login credentials confidential and not share them with anyone else.
• Notify us promptly at [email protected] if you suspect unauthorised access to your account.
• Maintain only one account per person — duplicate accounts are not permitted.
• Not use another user’s account without their express permission.

You are responsible for all activity that occurs under your account, including activity by anyone to whom you have given (or inadvertently allowed) access. We are not liable for any loss or damage arising from unauthorised use of your account.

You may use the Service only for lawful purposes and in accordance with these Terms. You must not:

• Use the Service in any way that violates applicable law or regulation.
• Scrape, crawl, or systematically extract data from the Service without our prior written consent.
• Reverse engineer, decompile, or disassemble any part of the Service.
• Sell, resell, sublicense, or otherwise provide access to the Service to third parties for commercial gain without our written agreement.
• Upload, post, or transmit any content that is unlawful, defamatory, obscene, offensive, or that infringes the intellectual property rights of any person.
• Use the Service in a way that places an unreasonable or disproportionate load on our infrastructure.
• Attempt to gain unauthorised access to any part of the Service or its related systems.
• Introduce malware, viruses, or other malicious code into the Service.
• Impersonate any person or entity or misrepresent your affiliation with any person or entity.

We reserve the right to suspend or terminate your access if we reasonably believe you have violated these obligations (see Section 12).

Biltong Buddy lets you create and store content including batch notes, recipe details, and photos.

Ownership. You retain all ownership rights in content you create or upload. We do not claim ownership of any user-generated content.

Licence to us. By creating or submitting any content through the Service, you grant Nerdbase a worldwide, non-exclusive, royalty-free licence to host, store, display, and distribute that content solely to the extent necessary to provide and improve the Service. This licence ends when you delete the content or close your account (subject to reasonable technical caching periods).

Your warranties. By submitting any content, you warrant that:

• You have the right to share it and to grant us the licence above.
• It does not infringe the intellectual property rights, privacy rights, or any other rights of any third party.
• It does not contain material that is unlawful, defamatory, obscene, or otherwise objectionable.

Moderation. We reserve the right, but are not obligated, to review, remove, or disable any user-generated content that violates these Terms or that we consider, in our sole discretion, to be harmful, offensive, or otherwise inappropriate. We will not be liable for any action we take or fail to take regarding user-generated content.

Deleting your account. You may request full deletion of your account and all associated data at any time by emailing [email protected] with the subject “Delete my account”. We will permanently delete your personal data within 30 days of receiving the request. This action is irreversible.

The Biltong Buddy name, logo, app design, user interface, source code, and all other materials that are part of the Service (excluding user-generated content) are owned by or licensed to Nerdbase and are protected by copyright, trademark, and other applicable intellectual property laws. All rights are reserved.

We grant you a limited, non-exclusive, non-transferable, revocable licence to access and use the Service for your personal, non-commercial purposes, strictly in accordance with these Terms. This licence does not include the right to copy, modify, create derivative works from, publicly display, sell, or sublicense any part of the Service.

Nothing in these Terms transfers any intellectual property rights to you. Any use of the Biltong Buddy name, logo, or branding without our prior written consent is prohibited.

As noted in Section 5, you retain ownership of content you create or upload. Our licence to your content is limited to what is necessary to provide the Service.

The Service relies on the following third-party providers. Each has its own terms of service and privacy policy, which we encourage you to review. We are not responsible for the practices or content of these services.

Links to third-party services or websites within the Service are provided for your convenience. We do not endorse, and are not responsible for, the content, privacy practices, or availability of any third-party service.

What the Service is and is not. Biltong Buddy records and displays information you enter. It tracks weight-loss percentages, drying durations, and environmental conditions that you log. It does not analyse, test, or certify the microbial safety of your biltong. It is not a substitute for professional food-safety advice.

Informational only. Any recipes, “optimal weight-loss targets,” suggested drying times, salt percentages, humidity guidance, or other food-related information displayed in or generated by the Service is provided for informational and reference purposes only. It does not constitute food-safety advice, dietary advice, or a recommendation that any specific piece of meat is safe to consume. It has not been reviewed, validated, or approved by any food-safety authority.

Your responsibility. You are solely and fully responsible for all food-safety decisions, including but not limited to:

• Selecting appropriate salt percentages, curing agents, and spice quantities.
• Controlling drying temperature, humidity, and airflow.
• Identifying mould and determining whether it is safe (white surface mould) or dangerous.
• Determining appropriate drying time for your specific meat cut, thickness, and environment.
• Deciding whether any individual piece is safe to eat before consuming or sharing it.
• Complying with all applicable food-safety laws and regulations before producing biltong commercially or sharing it with members of the public.

Regulatory guidance. Before producing biltong for sale or for sharing beyond your household, you should consult:

• The UK Food Standards Agency (FSA) — food.gov.uk — if you are based in the United Kingdom.
• The South African Department of Health and the National Regulator for Compulsory Specifications (NRCS) if you are based in South Africa.
• The relevant food safety authority in your own jurisdiction.

Vulnerable individuals. Improperly prepared biltong may pose a risk of serious illness, particularly to pregnant women, the elderly, young children, and individuals with compromised immune systems. If you are in one of these groups or are preparing food for someone who is, please take additional care and consult a qualified food-safety professional before consuming home-dried meat.

No warranty of safety. Nerdbase gives no warranty, representation, or assurance — express or implied — that following any guidance displayed in the Service will result in the production of safe biltong or safe food of any kind.

Assumption of risk. By using the Service, you expressly acknowledge and accept all risks associated with the production, handling, sharing, or consumption of biltong or other food produced in connection with your use of the Service.

Indemnity for food-related claims. To the fullest extent permitted by applicable law, you agree to indemnify and hold Nerdbase harmless from any claim, loss, liability, or expense (including reasonable legal costs) arising out of or in connection with food you have produced, shared, sold, or otherwise distributed using information from the Service. This indemnity does not affect any rights you may have under applicable consumer protection law.

Service provided “as is”. The Service is provided on an “as is” and “as available” basis without any warranty of any kind, whether express, implied, or statutory, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the Service will be uninterrupted, error-free, or free from viruses or other harmful components.

Consumer statutory rights. Nothing in these Terms affects your statutory rights as a consumer under the Consumer Rights Act 2015 or any other applicable consumer protection legislation. Some exclusions or limitations in these Terms may not apply to you if you are a consumer.

Liability cap. Our aggregate liability to you arising out of or in connection with these Terms or the Service shall not exceed £100. Nothing in these Terms excludes or limits liability for: (a) death or personal injury caused by our negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot be excluded or limited by English law. This cap will be revised when paid features are introduced.

Exclusion of indirect loss. To the fullest extent permitted by law, Nerdbase is not liable for any indirect, incidental, consequential, special, or exemplary damages arising from your use of the Service, including loss of data, loss of profit, loss of business, or loss of goodwill, even if we were advised of the possibility of such damages.

To the fullest extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Nerdbase and its officers, employees, and contractors from and against any third-party claims, damages, losses, costs, and expenses (including reasonable solicitors’ fees) arising out of or relating to:

• Your breach of these Terms.
• Your misuse of the Service or violation of any applicable law.
• Content you upload, share, or transmit through the Service, including user-generated content that infringes the rights of a third party.
• Any food-safety claim relating to food you have produced, shared, sold, or distributed using the Service (as detailed in Section 9).

This indemnity does not apply to claims caused by our own negligence, fraud, or wilful misconduct, and does not affect any rights you have as a consumer under applicable law.

By us. We may suspend or terminate your access to the Service, with or without notice, if:

• You materially breach these Terms and (where the breach is capable of remedy) fail to remedy it within 14 days of written notice from us.
• We reasonably suspect fraudulent, abusive, or illegal activity on your account.
• We are required to do so by law.

By you. You may terminate your account at any time by emailing [email protected] with “Delete my account” as the subject.

Survival. Upon termination, the following sections of these Terms continue to apply: Section 5 (User Content, including our licence to content we lawfully retain), Section 7 (Intellectual Property), Section 9 (Food Safety), Section 10 (Disclaimers & Limitation of Liability), Section 11 (Indemnity), and Section 16 (Governing Law).

We may revise these Terms from time to time to reflect changes in the Service, applicable law, or our business practices.

For material changes (those that affect your rights or obligations in a meaningful way), we will:

• Update the “Last updated” date at the top of this page.
• Send an email notification to your registered address at least 30 days before the changes take effect.
• Display an in-app notice the next time you open Biltong Buddy.

Your continued use of the Service after the effective date of revised Terms constitutes your acceptance of those changes. If you do not agree with the updated Terms, you must stop using the Service and may close your account before the effective date without penalty.

For minor or non-material changes (such as typographical corrections or clarifications that do not affect your rights), we may update the Terms without separate notice.

We make reasonable efforts to keep the Service available at all times, but we do not guarantee any specific level of uptime. The Service may be temporarily unavailable due to scheduled maintenance, infrastructure upgrades, or circumstances outside our control.

Planned maintenance windows will be announced on our status page at biltongbuddy.app/status wherever reasonably practicable.

We are not liable for any loss or inconvenience caused by Service interruptions, whether scheduled or unscheduled, except to the extent that such unavailability is directly caused by our negligence.

Neither party will be in breach of these Terms, or liable to the other, for any delay or failure to perform any obligation under these Terms (other than an obligation to pay money) if that delay or failure is caused by circumstances genuinely beyond the affected party’s reasonable control, including but not limited to: acts of God, natural disasters, pandemic or epidemic, war, terrorism, civil unrest, government action, industrial disputes, power outages, failure of the internet or telecommunications infrastructure, or failure of a third-party service provider.

The affected party will give prompt notice of the relevant circumstances and use reasonable efforts to mitigate the impact and resume performance as soon as practicable.

These Terms and any dispute or claim arising out of or in connection with them (including non-contractual disputes or claims) are governed by and construed in accordance with the laws of England and Wales.

You and Nerdbase each submit to the exclusive jurisdiction of the courts of England and Wales for the resolution of any such dispute or claim.

Consumer rights preserved. If you are a consumer resident in another jurisdiction, nothing in this clause removes any mandatory rights or protections that apply to you under the applicable consumer protection legislation of your own country. In such cases, this clause operates alongside, and does not override, those mandatory rights.

If you have any questions about these Terms, or if you need to exercise any rights under them, please get in touch. We aim to respond to all enquiries within 5 business days.

Parties. These Terms are between you and Nerdbase. Apple Inc. is not a party to these Terms and is not responsible for Biltong Buddy or its content.

Third-party beneficiary. Notwithstanding the above, you acknowledge and agree that Apple is a third-party beneficiary of these Terms with respect to the iOS application, and that Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

Licence scope. The licence granted to you in Section 7 is limited to a non-transferable licence to use the Biltong Buddy iOS application on any Apple-branded products that you own or control, and as permitted by the Usage Rules set out in the Apple Media Services Terms and Conditions.

Support and maintenance. Apple has no obligation whatsoever to provide any support or maintenance services with respect to Biltong Buddy. All support enquiries should be directed to Nerdbase at [email protected].

Warranty. In the event of any failure of the iOS application to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the iOS application (if any) to you. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation whatsoever with respect to Biltong Buddy. Any other claims, losses, liabilities, damages, costs, or expenses attributable to any failure to conform to any warranty are governed solely by these Terms and applicable English law.

Product claims. Nerdbase, not Apple, is responsible for addressing any claims you or any third party may have relating to Biltong Buddy, including but not limited to: (i) product liability claims; (ii) any claim that Biltong Buddy fails to conform to any applicable legal or regulatory requirement; and (iii) claims arising under consumer protection, privacy, or similar legislation.

Intellectual property. In the event of any third-party claim that Biltong Buddy or your possession and use of Biltong Buddy infringes that third party’s intellectual property rights, Nerdbase (not Apple) will be solely responsible for the investigation, defence, settlement, and discharge of any such claim.

Compliance. You represent and warrant that: (i) you are not located in a country that is subject to a US Government embargo or that has been designated by the US Government as a “terrorist-supporting” country; and (ii) you are not listed on any US Government list of prohibited or restricted parties.

Apple’s standard EULA. With respect to the iOS distribution of Biltong Buddy, we adopt Apple’s standard end-user licence agreement (EULA) as the minimum terms of use, available at apple.com/legal/itunes/dev/stdeula/, except to the extent modified or supplemented by these Terms of Use. In the event of any conflict between Apple’s standard EULA and these Terms, these Terms will prevail to the extent of the conflict unless Apple’s terms are required by law.
